WHAT IS A COOKIE?

Google states that it complies with the Privacy Shield principles and is affiliated with the Privacy Shield programme of the U.S. Department of Commerce. This means that an adequate level of protection is in place for the processing of any personal data.

FACEBOOK
Through our website, a cookie is placed by the American company Facebook as part of the “Facebook Pixel” service. We use this service to track and obtain reports on how visitors use the website and to display targeted advertisements on Facebook. A user profile is created during your visit to this website. Facebook may provide this information to third parties if Facebook is legally required to do so, or insofar as third parties process the information on Facebook’s behalf. The information is transferred to and stored by Facebook indefinitely on servers in the United States.

GENERAL POLICY ON DATA PROCESSING

Korlam takes your rights regarding data processing seriously. In this document, Korlam explains how it collects, processes and uses your personal data. It therefore constitutes Korlam’s general policy on data processing.

For questions about this statement and our policy, you can always contact the Information Security Team (IST) at GDPR@vt-invest.be. For requests that go beyond a request for information, we may ask you to identify yourself so that we can be sure that we provide the requested information and data to the correct person.

WHEN AND FOR WHAT PURPOSES DOES KORLAM COLLECT AND PROCESS DATA?
Korlam collects and processes data about you when, as a customer, you engage us to carry out works and/or to produce and supply materials, purchase real estate, subscribe to our newsletter, or contact us in another way. We summarise these activities under the heading “customer management”, which in particular concerns the implementation of the projects we enter into with you.

If you are a supplier/subcontractor, we process your data or the data of your contact persons in connection with the supply of products or services, for the general purpose of “supplier administration”. In that case, we may also include your data in our work planning, together with the data of our own employees.

Furthermore, we process your data, whether as a customer or as a supplier/subcontractor, when preparing invoices and other accounting documents. This constitutes the purpose of “accounting”.

In some cases, we also process your data as a prospect, i.e. a person who does not yet have contact or a contract with us, with the intention of presenting our services to you (direct marketing).

We may also contact you to provide information relating to products and services of other companies belonging to the VT-Invest Construction Group, of which Korlam is a part. Upon request via GDPR@vt-invest.be, you can obtain an overview of these group companies, or you can consult www.vt-invest.be.

Finally, we may process data about you because this is or may be relevant to our activities, for example in order to use your advice or services. We describe these activities as “communication” or “public relations”.

WHAT DATA DOES KORLAM COLLECT AND PROCESS?
Customer data
This concerns the data you provide to us and that we need to carry out the project for which you engage us, such as your name, address, telephone and mobile phone number, email address and professional data, such as company name and VAT number, data concerning your household composition, and all other related data. You usually provide this data to us directly, but it is also possible that we obtain it from your architect or other parties with whom you cooperate.
The data may also relate to your interests in or plans for a future project.

Supplier and subcontractor data
We collect and process the identity and contact details of our suppliers and subcontractors, as well as those of any (sub)contractor(s), their staff, employees, representatives and other useful contact persons. The purposes of this processing are the performance of the agreement, the management of suppliers/subcontractors, accounting and direct marketing activities such as sending promotional or commercial information.
To fulfil certain specific legal obligations (electronic attendance registration, 30-bis declaration of works), you may provide us with additional data to register your attendance (such as eID data, Limosa number, etc.).

HOW DOES KORLAM COLLECT YOUR DATA?
We collect your data when you complete forms for this purpose, whether on paper or electronically. Sometimes this takes place through the submission of documents and plans, a conversation, telephone contact or email correspondence.

We normally obtain this data directly from you. Sometimes we may also obtain it indirectly. This is the case for data concerning employees of suppliers/subcontractors who are active on our construction sites and which we obtain from the suppliers themselves.
We may also obtain your data from third parties for direct marketing purposes.

When you visit our website, we use cookies. More information about these can be found in our cookie policy published on our website. We do this in particular to tailor the content and ease of use of the website as much as possible to you as its user. In addition, we process your data in order to comply with the obligations arising from making a website and its content available and to enable you to use the interactive applications and services on this website.

Our workplaces, including construction sites, may also be equipped with cameras. The images may be used for various purposes (monitoring the workplace with a view to safety and health, protecting materials and equipment, construction-site monitoring, promotion and advertising, etc.). It cannot be ruled out that individuals may be recognisable in these images. These images may be retained indefinitely.

WHAT ARE THE LEGAL BASES FOR KORLAM’S PROCESSING OF DATA?
In principle, we collect and process your data on the basis of the contractual relationship we have with you as a result of your assignment and the contract we enter into with you. This is also the legal basis for processing data concerning customers and suppliers/subcontractors and for the processing activity “accounting”.

Where processing is not necessary for the performance of the contractual relationship, such as for direct marketing, customer satisfaction surveys and communication/public relations, it is based on our legitimate interests as a company, in particular freedom of enterprise and information. We always ensure that there is a balance between our interests and yours, for example by granting you a right to object.

IS DATA DISCLOSED TO THIRD PARTIES?
Your data is mainly processed internally in the context of customer management, supplier management, work planning, accounting and communication/public relations by the department/person responsible for these activities. For certain specific services or assignments, it may be passed on to processors/suppliers/subcontractors that we engage, always under our control.

Unless you object, your data may also be shared with the other companies of the VT-Invest Construction Group, of which Korlam is a part. Sometimes we are obliged to disclose data about you. This is particularly the case when we are legally required to do so or when public authorities that are entitled to do so request data from us. In that case, we verify whether the conditions for requesting the data have been met.

In principle, your data is not transferred to third countries or international organisations.

This may, however, occur in the context of contracts for cloud services that we enter into. Your data may then be stored on servers in third countries. In that case, we ensure that the provider of those services is established in a third country with an adequate level of protection or that an agreement is concluded with that provider to protect your rights.

DURATION OF PROCESSING
We retain and process personal data at least for the period necessary in view of the purposes of the processing and in view of the relationship we have with you, whether contractual or otherwise, and the legal requirements.
Sometimes we may retain your data indefinitely.

TECHNICAL AND ORGANISATIONAL MEASURES
We take the necessary technical and organisational measures to process your personal data with an adequate level of security and to protect it against destruction, loss, falsification, alteration, unauthorised access, theft or accidental disclosure to third parties, as well as any other unauthorised processing of this data.
Under no circumstances can Korlam be held liable for any direct or indirect damage resulting from incorrect or unlawful use of personal data by a third party.

Access by third parties
For the purpose of processing your personal data, we grant access to your personal data to our employees, staff members and representatives. We guarantee a similar level of protection by making contractual obligations enforceable against these employees, staff members and representatives, similar to those contained in this policy statement.

YOUR RIGHTS
You may always inspect the data we process about you and, if necessary, have it corrected or erased. To do so, simply submit a request to the IST via GDPR@vt-invest.be. We ask you to attach proof of identity in order to prevent your data from being disclosed to someone who is not entitled to receive it.

If we process your data for direct marketing purposes, you may object to this at any time. To do so, simply contact the IST via GDPR@vt-invest.be or use the unsubscribe option in the newsletter.

If your data is disclosed to the other companies of the VT-Invest Construction Group of which Korlam is a part, you may also object to this at the same address.

If you do not agree with the way Korlam processes your data, you may always lodge a complaint with the Data Protection Authority (www.privacycommission.be), Drukpersstraat 35, 1000 Brussels.

CHANGES
Korlam reserves the right to amend this statement and/or policy. Changes will be published through the website.
